The mother of a rape victim, who set fire to and killed her daughter´s rapist, has been spared prison once again, pending consideration of her application for a pardon for the offence she was found guilty of.
María del Carmen García was sentenced to nine years in prison for setting fire to her 13 year old daughters rapist in the Alicante town of Benejúzar, having first doused him in petrol. The man died several days after the incident from the severity of his burns. The sentence was later reduced to five and a half years based on the defense of “temporary insanity”.
The news came the day before María was due to enter prison on Thursday, that the Court has considered the application for a delay until the Council of Ministers resolved the pardon application.
“The pardon must come because I’m no killer”, María del Carmen said, “I now I’m crying with joy”, she continued, having resigned herself to facing prison, kept going by the “support of all the people” and “faith” from her lawyer.
Whist María del Carmen spoke, her daughter Verónica, the original rape victim, phoned family and friends to explain the details of the court order, with joy in her voice that “mom is not going to prison tomorrow, so this Sunday we can still go to the beach”, making plans with her brother.
Her lawyer has expressed his joy at the decision of the Court of Alicante and reiterated that, “what is needed now is for the pardon to come at once”, whilst also thanking the support of “all associations, the Council of Alicante and municipalities for having pushed this new request for clemency”.
The lawyer concluded that he will continue to fight for María, still gathering signatures of support and fighting for a pardon, not least because of the suffering the family has already endured.
